The Municipal Elections Act, 1996 as amended contains provisions that allow electors to request an audit of a candidate’s or third-party advertiser’s campaign finances if they have reasonable grounds to suspect the candidate or third-party advertiser has contravened the financial provisions of the Act. The review of these audit requests/applications is the responsibility of compliance audit committees; these arms-length committees must be established by municipalities before October 1st in an election year in accordance with the requirements of the Act. Bill 68 – the Modernizing Ontario’s Municipal Legislation Act, 2017 (MOMLA) – received Royal Assent on May 20, 2017, and made numerous changes to several pieces of municipal legislation, including the Municipal Elections Act (the Act). These amendments include changes to the mandate and operation of election compliance audit committees. Parry Sound established a WPS Election Audit Compliance Committee in 2010 by developing Terms of Reference and appointing members and joining with five other of the West Parry Sound Municipalities; Township of McKellar, Municipality of McDougall, Township of The Archipelago, Township of Carling, and Township of Seguin. New members were appointed in 2014 to cover that election period. After meeting with the West Parry Sound Area Clerks in the fall of 2017 and early 2018, new Terms of Reference were drawn up for the 2018 municipal election. All Area Councils agreed that the West Parry Sound Election Audit Compliance arrangement should continue with the revised Terms of Reference. The Municipality of Whitestone is part of a joint compliance committee made up of East Parry Sound municipalities as they have been in previous elections. By-law 2018-6806 contains the Terms of Reference, as agreed to by all parties, and the form required should there be request(s)/application(s). 2018 Election Financial Statements - Candidates and Third Party Advertisers |
Every Candidate shall file the "Financial Statement - Auditor's Report " Form 4 on or before 2:00 p.m. March 29, 2019 with the Clerk with whom their nomination was filed in accordance with Section 88.25 of the Municipal Elections Act, 1996, as amended reflecting the Candidate's election campaign finances as of December 31 in the year of the election. Every Third Party Advertiser shall file the "Financial Statement - Auditor's Report" Form 8 on or before 2:00 p.m. March 29, 2019 with the Clerk with whom they registered in accordance with Section 88.29 of the Municipal Elections Act, 1996, as amended reflecting the Third Party Advertiser's election campaign finances as of December 31 in the year of the election.
